Legal Status of Electropathy / Electro Homoeopathy...................
19th April, 1988 -N. E. H. M. of India & 51 members of Parliament requested to Prime Minister and after that Hon'ble Health Minister with regards to the recognition of Electropathy / Electro Homoeopathy Medical Science in India. Hon'ble Health Minister ordered to constitute.
1st Sep. 1988- Ministry of Health & Family welfare, Govt. of India Constituted an Inquiry an Inquiry Committee. Committee on Electropathy / Electro Homoeopathy Dr. N.K. Awasthy was nominated as an "Electro homoeopathy Expert"in whole India in the Inquiry Committee.
30th Dec.1990 -The Inquiry Commttee submitted its report to ministry of Health & F.W., Govt. of India for consideration.
22nd Feb., 1991 - Shri, jagannath singh, M.P. (Lok Sabha) and Chairman N.E.H.M. of India, New Delhi participate in a more than one hour debate over the merit of Electropathy / Electro Homoeopathy introduced recognition Bill No. 138190 (Private Member Bill). After the debate Hon'ble Deputy Health Minister, assured the Lok Sabha House that we will do whatsoever was possible in this regard.
16th May, 1991 - An Expert Committee was constituted by the Health ministry. four senior officers were selected to represent the four pathies while the fifth one (Electropathy / Electro Homoeopathy) all over India was allocated to Dr. N.K. Awasthy, Secretary N.E.H.M. of India.
19.05.95 - While replying a Private member Bill No. 20/93 introduced by the Chairman, NEHM of India, New Delhi in the Rajya Sabha, the Hon'ble Health Minister has stated that it is necessary to have more development of Electropathy Medical system. It will certainly recognise when the public will accept it.
10.07.95 - Dr. N.K. Awasthy has tie up & signed on an agreement with the "National Certification Agency for Health Care personnel (NCAHP) recognised by USA Govt. with NEHM of India, New Delhi for "Certification programme Certified Electro Homoeopathy Practitioners" (C.E.H.P.)
1.01.97 - Dr. N.K. Awasthy, Secretary, NEHM of India has signed an M.O.U. for Tech. Collaboration if I between NEHM of India, New Delhi and Dr. Y.S.P. University of H&F, Solan (H.P.) for technical know how in research of medicinal plants for electropathy and their medicinal properties.
18.11.98 - Hon'ble Delhi High Court while delivering the judgement in FAQ No. 205/92 New Delhi Govt. & Union of India Vs NEHM of India on 18.11.98, the Delhi High Court has ordered that NEHM of India may issue Diploma/Certificates and holders of such Diploma/Certificates are entitled to practice in Electropathy systems of medicines on the strength thereof. The Hon'ble HighCourt also directed the Central/State Govt. to formulate the functioning of electropathy on the lines of Sec. 17, 18, 19 & 19(A) Indian Medical Council Act. 1956.
20-06-2003 - The Directorate of Health Services, Govt. of Delhi in Correspondence with Govt. of India has also issued a notification vide No. F. 7(512)/2003/DHS/ HQ/CC/AQC/8115 dt. 20.06.2003 affirming the status of NEHM of India in terms of issuance of Diploma/Certificates by the NEHM of India Society and holders are entitled to practise in this system on the strength thereof.
22.07.2004 - The High Court of Punjab, Haryana and Chandigarh in its judgement/order passed in Criminal Misc. Writ No. 34949-M-99 dt. 22.07.2004 have categorically ruled and directed that when the 59 Electropathy Doctors including petitioner was practising in Electropathy, he was not required to get himself registered under Indian Medical Council Act 1956. Undisputedly, the petitioner was practising in Electropathy system of medicine. Therefore he was competent to practice in Electropathy system of medicine". The Hon'ble High Court also directed the administration and the medical authorities to quash F.I.R. if registered against any of the practitioner in the system of Electropathy.
NEHM OF INDIA & ELECTROPATHY IN THE EYES OF LAW
JUDICIARY SUPPORT :-Although several Court have delivered the favourable judgement regarding NEHM of India & Electropathy but some of the judgements are remarkable one which applicable to NEHM of India only.
(a) Order of Hon'ble Delhi High Court in FAO No. 205/92 dt. 18.11.98. The Division Bench of Hon'ble Delhi High Court consists of Mr. Justice Y.K. Sabharwal ACJ. & Mr. Justice K.S. Gupta had ruled while delivering the judgement in the matter of FAO No. 205/92 dated 18.11.1998 (Union of India & Delh Govt Vs N.E.H.M. of India) that N.E.H.M. of India may issue diploma/certificates and holders of such diploma certificates are entitled to practise Electropathy system of medicines on the strength thereof.
(b) Order of Hon'ble Supreme Court of India in SLP No. 11262/2000 dt. 24.11.2000. The Hon'ble Supreme Court of India has confirmed/concurred it by dismissing the SLP filed by Union of India & Delhi Govt. against the order of Hon'ble Delhi High Court FAO No. 205/92.The Hon'ble Apex Court has also maintained the statusquo of the order of Delhi High Court.
(c) Electropathy Medicines are cheaper, quicker & safer :- It may not be out of place to mention here that while attending an Electropathy Seminar Organised by NEHM of India and its affiliated Institute on 9th April, 2004 at Mumbai, Hon'ble Mr. Justice Shivraj V. Patil, Judge of Hon'ble Supreme Court of India has clearly stated that Electropathy Medicines are cheaper, quicker & safer. He also vehemently viewed that acceptance of the system by the people is primary & real recognition of any new medical system. He also advised to develop this medical system in the Society. Recently on 19th Nov. 2004 Mr. Justice Shivraj V. Patil, Hon'ble Judge, Supreme Court of India has also Unveiled/Inaugurated the Statue of Dr. Count Ceaser Mattei, the father/founder of Electropathy at the premises of NEHM of India where he expressed Several views regarding Electropathy as his sister about 70 years old is also using Electropathic Medicines for the treatment of Rheumatic Arthritis and now she is feeling much relief with electropathic medicines.
ADMINSTRATIVE/LEGISLATIVE SUPPORT :-
(a) Notification of Directorate of Health Services, Govt. of NCT of Delhi dt. 20.06.2003. The Directorate of Health Services, Govt. of NCT of Delhi in correspondence with Union of India has also issued a Notification Vide No. F.7(512)/2003/DHS/HQ/CC/AQC/8115 dated 20.06.2003 stating that NEHM of India may issue diploma/certificate in Electropathy/Electro Homoeopathy and the holder of diploma/certificate from NEHM of India are entitled to practice Electropathy System of Medicines on the strength thereof as stated in order of Hon'ble Delhi High Court in FAO No. 205/92.
(b) D.O. Letter from Smt. Shushma Swaraj, Former, Union Health Minister dt. 30.07.2003. The Former, Union Health Minister Smt. Shusma Swaraj has issued a D.O. Letter on 30.07.2003 accepting that Electropathy/Electro homoeopathy at the stage of development. This order has been issued after submission of the recommendation of high level Standing Council of Experts for ASM constituted by D.G., I.C.M.A., New Delhi complying the order of Hon'ble Delhi High Court in the matter of PIL CWP No. 4015/96 (Wg. Cdr. H.M. Sethi Vs Ministry of HRD & others) in which NEHM of India Society only Electropathy Organisation was pleaded as Respondent No.1 O. The details are available with the NEHM Society.
(b) Dr. N.K. Awasthy, Principal Secretary was also nominated as an Electropathy Expert Member in the Inquiry as well as Expert Committee of Electropathy constituted by Ministry of Health & F.W., Govt. of India previously during 1988 and 1991 to expedite the matter of Electropathy throughout India.
MEDICAL AND TECHNICAL SUPPORT :-
a) Medical/Technical Collaboration(s) :- NEHM of India has also the Tech. Collaboration with two eminent Universities viz Dr. Y.S.P. University of Horticulture & Forestry, Solan & G.B. Pant University of Agriculture & Technology, Pant Nagar to know how the technical aspects in the extration of essences from medicinal/aromatic plants, provide their seeds and also to see their medicinal properties. In addition to this NEHM 9f India has also Medical Collaboration with Ministry of Public Health, Ukraine (Europe) to exchange medical education between boath organation with latest techniques.
LATEST :-
On 25 Nov., 2004 during the course of argument/discussion the Ministry of Health, Govt. of India has submitted an Affidavit before the Hon'ble Supreme Court of India stating that Govt. is going to make the legislation draft within the period of 8 weeks as had been given in the order of PIL CWP No. 4015/96 dt. 18.11.98. NEHM of India is pleading as intervener in this case.1
